Pennsylvania Progressive Summit To Take Place In Early February

January 19, 2012

One of the nations largest gatherings of progressive thinkers is happening right here in Pennsylvania in three weeks at the PA Progressive Summit 2012. The event will be held February 10-12 at the Pennsylvania Convention Center in downtown Philadelphia.

The event will play host to several guest speakers, including US Senator Daylin Leach, and also, secretary-treasurer of the National Education Association, Democracy for America Chair Jim Dean. Harrisburg attorney, Scott Cooper, with the firm of SchmidtKramer is also slated to speak over the weekend.

Workshops and networking opportunities focusing on topics such as workers rights, healthcare, the environment, as well as budgeting and legislative issues are also on the agenda. Attendees will have the opportunity to participate in up to six different workshops throughout the weekend on topics of their choosing.

Another noteworthy event being held at the Summit is the first debate between candidates for the positions of Pennsylvania Attorney General and Auditor. The AG debate will be held Friday, while the Auditor debate will occur Sunday afternoon.

Registration for the Summit is open to the public and can be done online at a cost of anywhere from $50-$150, depending on how many days you would like to attend.

Defendants’ Attempt To Obtain Plaintiff’s Social Media Information Denied

The Court of Common Pleas in Franklin County, Pennsylvania in Arcq v. Fields et al, No. 2008-2430 (Herman J. Franklin Co. Dec. 7, 2011) recently addressed a developing issue regarding the discoverability of a Plaintiff’s social network profile and information. The Plaintiff objected to interrogatories seeking social network information by arguing that the materials are not relevant and the Plaintiff has a reasonable expectation of privacy to such information. The Defendants argued that under other trial court cases, and one from the same court, the information is discoverable.

The trial court finds that there is one glaring difference the present case has from the others, and that is that the request of the Defendants in Arcq is not the result of viewing the public portion of the Plaintiff’s profile. In the other cases the Defendants viewed the Plaintiff’s public portion of the profile and then had reason to request the private portions of the social website. In Arcq, the Defendants made no such showing. Thus, the trial court denies the Defendants’ Motion.

McQueary’s Comments On Sex Abuse Scandal May Hurt His Credibility

The scandal at Penn State regarding a football coach’s alleged sexual indiscretions with young boys has received nationwide media exposure. But more interesting to many are the stories of other coaches who did little to stop the abuse they knew was happening.

In one such case, Assistant Coach Mike McQueary argued his innocence with a friend through an email. WHPTV Channel 21 News reports that McQueary testified to a grand jury that when he walked in on Sandusky raping a boy in the locker room shower at the school in 2002, he did not go to police, but instead told his supervisor, Joe Paterno.

Now, in the email obtained by media sources, McQueary has responded to the allegations to a friend by saying, “I did stop it, not physically, but I made sure it was stopped when I left that locker room.” These statements may have been a mistake according to Attorney Scott Cooper with SchmidtKramer Injury Lawyers.

Cooper explains that the statements may hurt McQueary’s credibility in court and could hurt his overall case. “There were other incidents that happened after 2002–he’s now potentially exposed himself to more civil liability than he thought,” Cooper said.

Warning: Reminder About Watching For School Buses

Harrisburg’s ABC TV-27 (WHTM) is reporting that, according to police reports, a man driving erratically in York Township on Octboer 11, 2011 crashed into a school bus filled with students.  Reports are that Abimael Gonzalez of York was weaving in and out of his traffic lane around 6:54 a.m. He then drifted into the opposite traffic lane on Springwood Road and hit a school bus headed for the Dallastown Area School District.   Although eight students and the driver were on the bus, there are no initial reported injuries.

However, this incident reminds us all that the school year is upon us and all drivers need to be extra careful when operating a vehicle in or near a school zone or bus.  Also, keep in mind that their are additional penalties for violating school bus zone and safety provisions of the Pennsylvania Motor Vehicle Code.

Pennsylvania Woman Crashes Into Man’s House, Again

September 22, 2011

A South Park, Pennsylvania, woman who was navigating the cul-de-sac on the way out of her neighborhood evidently lost control of her vehicle, crashing into a neighbor’s house on Tuesday afternoon.

The homeowner told MSNBC that it’s not the first time that the woman has crashed her car into his property.

The woman was said to be headed out for a shopping trip with a friend, who was her passenger. Both women were uninjured in the crash.

The passenger told Channel 4 Action News that she and her friend have lunch together once a week, but that on this day their ride to lunch was more dramatic than usual.

“We get back in the car, we go up the hill, she’s turning around and I wasn’t looking at what she was doing,” said the passenger. “I was looking to the side. All of a sudden I felt the car accelerate and I say, ‘Nancy!’ Then I saw the curtains in the bathroom of this house. I about died and so did she.”

The homeowner, who says he thinks the driver needs to forfeit her license, said, “First time it happened, my daughter’s car was parked right there. The same lady actually ran into the car and knocked it halfway off the wall.”

Motorist flees wreck that claimed life – Tioga County (Williamsport Sun Gazette)

MANSFIELD – A Tioga County motorist who fled the scene of a crash early Friday morning that killed the passenger riding in his pickup truck later was apprehended and jailed, according to state police.

Ulises Sanchex Cruz, 20, of 2564 Hills Creek Lake Road, Wellsboro, was charged with accident involving death while not properly licensed as a result of the 12:30 a.m. crash that claimed the life of Sergio Moreno Lemus, 38, of Fort Worth, Texas, police said.

Cruz was traveling south on Route 287 near Hammond Lane in Tioga County’s Middlebury Township when his truck struck a guardrail and went down an embankment, rolling over once, police said.

Lemus was ejected from the vehicle and killed instantly, police said. Cruz climbed out of the wreckage and fled on foot, but he was located Friday night at an undisclosed location and taken into custody. Following his arraignment, he was placed in the Tioga County Prison in lieu of $75,000 bail.

Deadly holiday weekend for Lancaster auto accidents

Do you think more accidents happen on holiday weekends? That could be the case, as two separate Pennsylvania auto accidents caused fatalities over the weekend.

WGAL reports both victims were in their early 20s. The first Pennsylvania auto accident happened when a female driver lost control of her vehicle and struck a tree. She was thrown from her vehicle. The second accident occurred when a man lost control of his car and struck another vehicle head on. He was pronounced dead at the scene of the Pennsylvania auto accident.

Police car involved in Harrisburg auto accident

Pennlive.com reports that an on-duty police officer was involved in a Harrisburg auto accident.

The officer was responding to a call about a shooting, with his lights and sirens on, when the Harrisburg auto accident occurred.

The officer was driving southbound into an intersection of stopped traffic, when he moved into the northbound lane of traffic heading the opposite direction. He crashed head on into a vehicle in the northbound lane, resulting in the Harrisburg auto accident.

The driver of the vehicle had a 4-year-old passenger. They were transported to the hospital, but no injuries were reported.

The driver of the car was ticketed for failure to yield to an emergency vehicle.

12 year old causes Lancaster auto accident

ABC News 27 reports that a 12-year-old boy stole a car and caused a Lancaster auto accident.

The boy stole a car from the 1500 Block of Passey Lane and was driving down Millersville Pike when he turned left onto School House Road in front of another vehicle.

The boy tried to flee the scene after the Lancaster auto accident, but he was detained by witnesses until the police arrived. He was charged with theft, accidents involving injury while not properly licensed, driving without a license, and left-turn violation.

Man killed in Lancaster auto accident

A man was killed over the weekend in a Lancaster auto accident.

WGAL reports that the head-on Lancaster auto accident happened on Route 441 in the East Donegal Township. The Lancaster auto accident happened in front of the Armstrong World Industries plant.

The victim was wearing his seatbelt at the time of the Lancaster auto accident. However, the driver of the other vehicle involved in the crash was not wearing his seatbelt at the time of the Lancaster auto accident.
