Unused vehicle is Ruled not Entitled to UIM Coverage

Attached is a link from 10/25/07 where the Third Circuit in a Not Precedential Judgment Order affirms the District Court in Allstate Indemnity Corp v. Coroniti where the insured was seeking UIM coverage on 2 vehicles that were only covered for comprehensive insurance and not liability insurance since the insurance was "suspended" on the two vehicles. The Court first finds that since there was an ambiguity in the policy, it was not an error for the District Court to look at extrinsic evidence to determine that the insured only sought comprehensive coverage on the vehicles. Second, The Court follows Nationwide v. Calhoun, 635 A.2d 643 (Pa. Super. Ct. 1993) and holds that as matter of law a policy providing only comprehensive coverage is not a motor vehicle liability insurance policy. Thus, there is no coverage under the decision.
