New Superior Court Case on Right a Jury of 12

Attached is a copy of a new Superior Court decision today in Gianni v. Phillips reversing the trial court's decision to deny a new trial in a case where the plaintiff did not waive the right to a jury of 12 where their was a previous demand for one made. The Defendant agreed to a jury of 8 but the plaintiff did not agree to it and there was a verdict in favor of the Defendant. The Plaintiff appealed and the Superior Court holds that the Plaintiff was entitled to a jury a 12.
