New UM Companion Case (follow up)Below is a link to Paravati v. Port Authority of Allegheny County last week 12/29/06 where in a companion case to the Lowery decision the Commonwealth Court holds that sovereign immunity does not bar a claim against it for UM benefits (also see Lowery) but also that the insured is not precluded from receiving UM benefits from the bus company and also UM benefits on their own personal motor vehicle insurance policy. The person is just not allowed to stack the coverage’s under Section 1774 from the uninsured recovery but can still proceed with stacking under Section 1733. It also did not matter that the person insurance policy paid UIM monies and not UM monies. [Read More - Article PDF]
