Trial Court Grants New Trial After Insurance Company Not Identified

The trial court in the Allegheny County Court of Common Pleas in Stepanovich v. McGraw and State Farm Ins. Co., GD 10-16523 (Allegheny Co. July 31, 2012) recently entered an Order involving a motion for a new trial after the insurance company was not identified at the trial. Judge O’Reilly grants a new trial to the Plaintiffs in light of Plaintiffs’ failure to identify underinsured motorist (UIM) carrier to the jury in a combined 3rd party/UIM case.
There is no opinion as of yet, only the Order granting the motion as a denial of due process to not identify the insurance company.
