Pa. Superior Court – Section 1731 Applies To Corporate Fleet Policies

Yesterday’s Superior Court opinion in Egan v. USI Mid-Atlantic, Inc., — A.3d — (Pa. Super. Ct. April 2, 2014), involving the applicability of the rejection of stacking waiver on a corporate fleet policy.  The court discusses the entire Motor Vehicle Financial Responsibility Law (MVFRL) and the how Sections 1731 and 1738 work.  The Superior Court concludes as a matter of law (p.13-14) that Section 1731 mandates UM/UIM coverage must be offered in the commercial fleet context, and any rejection form must comply with Section 1731.
